Can the U.S. Government Still Be Regarded as a Federal System of Government - Essay Example Across America’s history, federalism has been defined in different ways. Cooperative federalism implies that the two forms of government are to work in collaboration with one another. Dual federalism supposes that the two forms of government are working separate from one another. Creative federalism relates to a combined planning and decision making system amongst the two. Horizontal federalism relates to the interaction and shared programs amongst them while vertical federalism means the conventional systems of federal governance whereby the actions of the central government are considered to be supreme as interpreted by the constitution. Every state in the US is characterized with its own positions relative to legal authority and political importance. Although states are not considered sovereign entities they can assume power and take actions relative to the functions of other governmental set ups (McKAY, 2001). The US Constitution had established division of authority among st the state and federal governments that had initially put restraints on the federal government in areas of foreign policy, defense and the controls over currency and commerce amongst states. Over time, this bifurcation of authority has been diluted and currently the federal government enjoys extended authority relative to almost aspects impacting US citizens. However, despite such increase in federal authority, states in the US continue being very significant centers of governmental functioning. Over the years, there have been different policies enacted by different Presidents in regard to reducing the federal government’s powers and vice versa.... This essya stresses that federalism is understood as a governance system whereby the constitution partitions power amongst the state and central governments and both governments take direct actions relative to the people they rule, in terms of the prevailing laws. It is understood that both entities are supreme in the context of their respective spheres of authority. The central and state governments are required to give their consent in the event of proposals being made for changing the constitution. Very rarely does federalism appear in discussions and debates pertaining to modern public policies. A good feature of federalism is that it retains power, traditions and local dignity while permitting the central government to deal with common issues. This paper makes a conclusion that the founders of the Constitution displayed a great deal of loyalty towards their respective states and were not inclined to provide unlimited powers to the central government. While framing the Constitution, the founders created a document that greatly succeeded in bifurcating powers while creating a balance in favor of the nation as a whole. However, it is widely perceived that over the decades the US has diverted from what was intended by the founders of the Constitution because the original intent was not to provide the federal government with extensive authority over issues relative to law enforcement, housing and education

Create A Classic Detective Story Essay In this assignment I will analyse the classic Sherlock Holmes detective story the Speckled Band and find out how sir Conan Doyle takes a basic idea from all detective stories, a murder and still create a classic story.  First off a detective story needs a murder and in this case it was the death of Sarah stoner that starts the story off, but no death in any detective story would be complete without a mysterious death and the way Sarah died was a mystery. And I think that most detective stories use mysterious deaths because this makes the story more interesting and more intriguing because if the death was straight forward then the reader might be able to predict the ending of the story before actually reading the end of the story. This story also has its fair shares of mysterious characters for instance Helen Stoner, who is Sarah stoners sister is as mysterious as they get, like when she first met Sherlock she was wearing black clothes like she just came from a funeral. But why use mysterious characters? Because it is these characters that keep the reader guessing as to who the suspects may be and sometimes the writer can use this as an advantage to create a huge twist in the end of the story. The story describes the atmosphere as well such in the case of Sarahs death the atmosphere was described as dark, mysterious sounds etc and this is very important to use descriptions of certain atmospheres and locations because they will help the reader create a sort of picture of the scene in their heads therefore making them want to read more because it helps them get more involved with the story and also makes them think about whats going to happen next. The location of the story is also important and in this story most of the tension is created in the mansion of Helen stoner, which is owned by Dr Roylott. And in this mansion are a number of false clues such as in the room of Sarah stoner theres an emergency bell that dont work, her bed bolted to the ground, no windows and a ventilator that goes straight in to Dr Roylotts room. But the biggest false clue to me was the title itself the Speckled Band and it was pure genius for Conan Doyle to use a title like this because some people read the story purely out of curiosity to find out what the speckled band was. So by using mysterious deaths, mysterious characters, atmospheres, locations false clues the writer is able to draw the reader in the story, use tension to create questions in the mind of the reader but it also helps the writer stay 5 steps ahead to create a classic detective story.

Sound reinforcement for the concert involves a myriad of equipment each with it’s own design criteria. Finally, if the concert is to be recorded and produced on a CD, all the recording equipment would need to be designed as well as the studio that it is used in. To design something is to conceive and invent. It is the art of creating the arrangement of parts or details of something. Furthermore, the point of designing something is to meet a need or to solve a defined problem. Each of the different design tasks involved in the concert scenario requires a different type of design expertise. There are basically four areas of design involved - acoustics, electronics, industrial design and mechanical design. Each of these areas overlaps with the other somewhat. Furthermore, each of these areas has an ‘art’ side and a ‘science’ side to them. Acoustic designers create the plan for performance spaces like concert halls as well as recording studios, and any other space that needs to provide a quality listening environment. They may also be involved in specifying equipment to provide sound reinforcement in the venue. Some acoustic design firms offer a full range of services, which may include site analysis, interior design, lighting, power and HVAC systems, wire management, budgeting, construction administration, and acoustic tuning (Droney).

Andrew Lang, Ballad of a Worldly Wealth Explication

In the poem Ballad of a Worldly Wealth, Andrew Lang shares his opinion of wealth and what people use it for. It can be either useful, or just corrupt you. â€Å"Money maketh evil show† he says, meaning that if you use it in the wrong way it can show your evil side. It brings you worldly things, but it can’t bring you everything. Such as family, friends, or love. All it can give, it physical things that you won’t be able to take with you when you leave this world.He uses a lot of repetition to make the idea clear of what he means, and his belief of money. I feel like the meaning goes deeper than that also. You can either be rich in heart and be happy or you can be rich with physical things and fall into greed and darkness. In the poem he says, â€Å"Money maketh sin as snow. † I interpret this as him saying money can make everything right in some people’s eyes. Lang could have possibly got his idea from a book in the bible, 1 Timothy verse 6. For mon ey is the root of all evil. † He uses a lot of words that help to set his tone, and the emotion in the poem. The words he uses have a lot of the same sounds such as maketh, taketh, youth & truth. I found that many of the words in the poem were hard to understand because we do not talk in this form of language anymore. An example of these words would be â€Å"while the tides shall ebb and flow. †

Supreme Court Justice Clarence Thomas Biography Arguably the most conservative justice in recent U.S. Supreme Court history, Clarence Thomas is well-known for his conservative/libertarian leanings. He strongly supports states rights and takes a strict constructivist approach to interpreting the U.S. Constitution. He has consistently taken political conservative positions in decisions dealing with executive power, free speech, the death penalty and affirmative action. Thomas is unafraid of voicing his dissent with the majority, even when it is politically unpopular. Early Life Thomas was born June 23, 1948, in the small, impoverished town of Pin Point, Ga., the second of three children born to M.C. Thomas and Leola Williams. Thomas was abandoned by his father at the age of two and left to the care of his mother, who raised him as a Roman Catholic. When he was seven, Thomas mother remarried and sent him and his younger brother to live with his grandfather. At his grandfathers request, Thomas left his all-black high school to attend seminary school, where he was the only African American on campus. Despite experiencing extensive racism, Thomas nevertheless graduated with honors. Formative Years Thomas had considered becoming a priest, which was one reason he chose to attend St. John Vianneys Minor Seminary in Savannah, where he was one of just four Black students. Thomas was still on track to be a priest when he attended Conception Seminary College, but he left after hearing a student utter a racist comment in response to the murder of Dr. Martin Luther King, Jr. Thomas transferred to the College of the Holy Cross in Massachusetts, where he founded the Black Student Union. After graduation, Thomas failed a military medical exam, which excluded him from being drafted. He then enrolled in Yale Law School. Early Career Immediately after graduating from law school, Thomas found it difficult to obtain a job. Many employers falsely believed that he received his law degree due only to affirmative action programs. Nevertheless, Thomas landed a job as an assistant US attorney for Missouri under John Danforth. When Danforth was elected to the U.S. Senate, Thomas worked as a private attorney for an agriculture firm from 1976 to 1979. In 1979, he returned to work for Danforth as his legislative assistant. When Ronald Reagan was elected in 1981, he offered Thomas a job as Assistant Secretary of Education in the Office of Civil Rights. Thomas accepted. Political Life Not long after his appointment, the president promoted Thomas to head the Equal Employment Opportunity Commission. As director of the EEOC, Thomas angered civil rights groups when he shifted the focus of the agency from filing class-action discrimination lawsuits. Instead, he concentrated on reducing discrimination in the workplace, and emphasizing his philosophy of self-reliance for African Americans, chose to pursue individual discrimination suits. In 1990, President George H.W. Bush appointed Thomas to the U.S. Court of Appeals in Washington DC. Supreme Court Nomination Less than a year after Thomas was appointed to the appeals court, Supreme Court Justice Thurgood Marshall- the nations first African American Justice- announced his retirement. Bush, impressed with Thomas conservative positions, nominated him to fill the position. Facing a Democrat-controlled Senate Judiciary Committee and the wrath of civil rights groups, Thomas faced stiff opposition. Recalling how conservative Judge Robert Bork had doomed his nomination by providing detailed answers at his confirmation hearings, Thomas was hesitant to provide lengthy answers to interrogatories. Anita Hill Just before the end of his hearings, an FBI investigation was leaked to the Senate Judiciary Committee regarding sexual harassment allegations leveled at Thomas by former EEOC staff worker Anita Hill. Hill was aggressively questioned by the committee and offered shocking details of Thomas alleged sexual misconduct. Hill was the only witness to testify against Thomas, although  another staffer offered similar allegations in a written statement.   Confirmation Although Hills testimony had transfixed the nation, preempted soap operas and competed for airtime with the World Series, Thomas never lost is composure, maintaining his innocence throughout the proceedings, yet expressing his outrage at the circus the hearings had become. In the end, the judiciary committee was deadlocked at 7-7, and the confirmation was sent to the full Senate for a floor vote with no recommendation being made. Thomas was confirmed 52-48 along partisan lines in one of the narrowest margins in Supreme Court history. Service to the Court Once his nomination was secured and he took his seat on the High Court, Thomas quickly asserted himself as a conservative justice. Aligned primarily with conservative justices William Rehnquist and Antonin Scalia, Thomas is nonetheless his own man. He has offered lone dissenting opinions, and at times, has been the sole conservative voice on the Court.

Cohabitation The article that I used for this abstract was titled â€Å"Let’s Stop Harassing Couples Who Finally Commit.† This article talks about the movie â€Å"High Fidelity† and how every Catholic Priest should see it. The author of this article talks about how priests and parents are against cohabitation and how they feel it is a sin. It is a shame that some parents agree with these closed-minded and old-fashioned priests. Parents do not want their son to marry a â€Å"tramp† but that is exactly what they, the parents, percive her to be since she is living with their son prior to marriage. God forbid that a couple has pre-marital sex. My cousin is getting married in September and they had to get a priest who would marry them. Since they live together it was very hard to find a church that would marry them as well. The author of this article, unlike the priests he spoke of, is very open-minded. It is not fair to have to go through hours and hours of counseling to make sure that you are right for each other. To me it is pretty stupid in fact. If you love someone enough to marry him or her than go for it. No one should have the right to say that you cannot be married in a church. That is just not right. And what about the couples that cannot afford to live separately before they are to be married. For example, my roommate is getting married next September as well. They cannot afford to get separate apartments after school because of money. However, the bride to be’s parents will not allow her to live with him. That’s not fair either because if they do live together, they can get some money saved to pay for the wedding, pay school loans, or even save for a down payment on a house. They’re lazy, live with their parents, are totally entitled, etc. The list goes on. If you’re a millennial, this can do a lot to hamper your self-esteem and even your career goals. But a lot of the hate out there is based on very little fact. Millennials aren’t much different from any other generation that came before. In fact, if naysayers bothered to talk to millennials, they’d find that this young generation has the same career aspirations, life goals, and general motivation as older generations. Plus, they’re indispensable: millennials will make up more than 50% of the workforce in the years to come.Given all of that, we should start debunking a few of those millennial myths.Myth #1: Millennials are all â€Å"me, me, me,† all the time.Reality: Every generation is all â€Å"me, me, me.† It’s just human nature. Current Market Situation 1 Market description Bulgaria isn't renowned for specialist sports stores. The news for sports goods businesses is generally positive, given Bulgaria's negative expectations for rapid economic development being one of the poorest members of the EU. Meanwhile, some analysts expect sports clothing and shoes to climb in demand. â€Å"The global economic crisis has not yet significantly affected the sport goods market because when people cannot afford to buy apartments they prefer buying goods such as trainers,† said Kr Tsonov, (Director of Sport Depot). Tsonov said annual turnover of branded sport goods in Bulgaria last year was approximately Euros63 million, relatively small for a population of 7. 5 million people. The figure doesn't include significant equipment imports from China and Thailand. Germany's Adidas has some 40% of the market share, with revenues of about Euros 39 million annually. The US Nike and German Puma brands each earn Euros 19 and 13 million over the same period. The Bulgarian sport goods market is still developing. Branded sport clothes and shoes are generally favored sales compared to specialized sport equipment, including that for extreme sports. But the current small volume of sales is the main reason why large international sports chains have yet to enter the market. Currently, specialized sport goods are offered by a large number of retailers, but most dealers have just one store. In Sofia, there are about 20 such stores and countrywide there are around 70. But mass distribution has yet to gain a stronghold. When it does, as large brands seek to leverage growth in untapped territory with franchising deals, the Bulgarian sports market will streak away. The main consumers of Nike products can be divided into the following major segments: proffessional athletes (approximately 65  000); †¢ active amateurs (between 20-55 years of age, 368 728), †¢ students (fashion or trend fostered, approx. 896 734); †¢ young active people (between 15-19 years of age, who practice sport for good body shape or just for health, approx. 220 937) and †¢ people from upscale market (usually earn above the average for the country, who would like to feel comfortable and look good when training, approx. 00  000). Product characteristics include light weight, high innovation and cushion technology. Active amat eurs and people from upscale market are concerned with low risk of injuries and better performance. Product can be viewed with light weight and cushioning technology. Air Max a renowned running shoe by Nike, specially designed to provide the ultimate in impact protection — reducing shock and distributing pressure, best characterizes the product. Given that the product prices are realistic Nike is offering to its customers, it is doubtful whether all customers think alike. This may represent a weakness, having in mind the lower output of the economy in Bulgaria. To overcome any future problems, especially in high price line, Nike is open for emerging technologies and heavily invests in innovation towards the development of new products, specifically the Nike Alpha Project, a revolutionary new line of athletic shoes. Nike was negligent in the past towards the mid-to lower-price-point products, which offers another gap for improvement. To better develop competitive position at all price points more resources and time should be dedicated. Thus, seeking the right marketing mix to best contribute to its goal of maximum profitability. Product: Nike understands the importance to satisfy every aspect of the consumer market in Bulgaria. To penetrate the competition and gain market share Nike should have an extensive range of products. Key point is to provide features, designs, various brands, packaging and benefits like extra warranties and after sale service. There is need to cater different market segments and every segment has specific requirements as well as individuals. Customized solutions of the product can be offered and shaped as per the requirements of the customer. Warranties of one year can be offered for the products and in case of defects or problems occur after purchase a replacement can be offered. This can be referred as after sale service and will help in keeping loyal customers. The competitor Addidas is offering only 6 month warranties for the Bulgarian market. There is an increasing interest in the consumer for high end brands and collaboration with other companies could trigger more sales and recognition. E. g. selling i-pods with their jogging shoes range. Price: Internationally Nike is positioned at high-end consumer market with high disposable income looking for better service and top of the line product. Basically the strategy is to provide high cost with maximum profitability, hence high profit margins. That can be justified by higher cost for innovations and advertisement collaboration with top sport athletes. A possible solution specifically for Bulgaria to overcome the high cost is to introduce special promotions during the festive season or low sales periods or by selling out old models. Place: Nike has developed wide range of distribution channels worldwide. Appropriate for the local market are retail channels: retails stores, brand stores and exclusive show rooms. Online shopping is another means of distributing its various products and its less costly compared to the rest methods. Distributers are commonly engaged to support its retail outlets. Factory outlets can have a major role in the down market, where discounted products can be disposed. Promotion: Nike has one of the most comprehensive promotion and advertising. Competitors will definitely follow Nike in its conquest for taking market share and probably use similar methods for generating more customers. Depend in large part on first mover and economy of scale. IV. Marketing Strategy Nike hopes to create customer value and relationships by identifying three key to success strategies that they believe will be instrumental in reaching sustainable profitability. The first  is the necessity to meet the customer's needs by offering the most comprehensive selection and knowledgeable staff. The second key to success strategy is  the need to monitor the competitive environment in an effort to ensure differentiation. Hutchison Port Holdings (HPH) is the world's leading port developer, operator and industry leader in using technology to improve all aspects of port administration. HPH actively invests in the development of modern port infrastructure and is committed to playing a significant role in the development of the economies and the expansion of international trade opportunities for the countries in which it operates.Therefore, to coordinate many ports around the world, HPH had created nGen, a calable system that would facilitate port operations in many languages on several continents and across many different time zones.The nGen System Increasing use of information technology (IT) at the ports has streamlined the transportation supply chain and made local manufacturers and import-export businesses more internationally competitive. In order to remain competitive, HPH need to develop a new terminal management system to efficiently and effectively control all port operations around the globe.Th e nGen system would control perations including ship and yard planning, gate operations, vessel operations and interactions, yard confguration and performance, overall operations monitoring, equipment utilization, productivity and cost optimization This project is the first major system codevelopment project between two of HPH's subsidiary ports, the Hong Kong International Terminals (HIT), the flagship operation of HPH in Hong Kong, and Yantian International Container Terminals (YICT) that located in Shenzhen, China. . Challenges to develop the nGen System a. The project teams need to solve all the variances. Each of HPH's ports is different in size. So, it's required to comply with differing sets of regulations contingent upon local trade and customs policies. Besides, it's located on different continents, in different time zones, and with personnel who speak different languages. b.The project team needs to consider the interests of a diverse group of stakeholders The project team needs to consider the terminal operations, operations development and information services. The project also, would need to effectively manage input from these groups. c. The scope of the project The project team would have to ensure that it allocated adequate time to complete ach part of the project. The project team began work in February 2001 and the deadline was in August 2005.

A Rose for Emily: a Themes of Death and Change Essay

William Faulkner explains why the story is not about him, but his details about a lonely poor woman named Miss Emily is very unpredictable. Miss Emily is unable to grip the idea of death and suffers from denial. After the death of her father, the people from the town expected her to be in a state of grief but she is not. Instead, she proceeds to say that her father is very well with her and alive. William Faulkner’s idea of grieving is clear in this story because he shows his audience that it is better to accept death than to ignore it through the accounts of Miss Emily’s journey. William Faulkner’s story takes place in the South, during a time period of racial discrimination and major changes. By using reader response criticism, a reader can analyze â€Å"A Rose for Emily† through the aspects of the secret held within the story, race found through anthropology, and gender found through anthropology. To begin with, one can analyze â€Å"A Rose for Emily† by examining the hidden message found in the story. The hidden message that William Faulkner tried to convey in his story was the themes of death and change. For example, Emily told them that her father was not dead. Miss Emily tried to defy death by holding on to her father’s corpse and treating it as if he were still living and how fearful she was of change. She later killed Homer to ensure that he would never leave her. Miss Emily continually tried to prevent any sort of change through death or other means from occurring in her town. She was so frightened of change that she wouldn’t allow the city to put numbers on her house for mail. The next step to analyzing â€Å"A Rose for Emily† is to examine race found through anthropology. The South was once known for its extreme prejudice and racism. William Faulkner’s attempts to convey this racism is made clear in â€Å"A Rose for Emily†. Mr. Faulkner explains the roles of women in the South and how they were seen through the eyes of men. When Miss Emily Grierson died the whole town went to her funeral. The men out of respectful affection for a fallen monument and the women mostly out of curiosity. In conclusion, there are many aspects that were incorporated into â€Å"A Rose for Emily†. William Faulkner was able to create a story involving many ideas about society and how it functioned in a specific time period in the South. To further examine â€Å"A Rose for Emily†, one can use the reader response criticism and analyze the aspects of the hidden message found within the story, race found through anthropology, and gender found through anthropology. â€Å"A Rose for Emily† is an important element in literature due to examination of the effects of change created in the olden South.

Therefore, underst anding these elements are quite beneficial to the new or technological good manufacturers especially those who intend to introduce new goods into the market (Mohr, Sengupta, and Slater, 2010; pg. 101). However, purchasing new technological goods will require more than the risk perception on the good, but will also require limited theoretical assessment of the entire purchase process that is defined within six risk dimension that include the assessments of the performance risk, financial risk, physical risk, convenience risk, social risk, and psychological risk (Pride and Ferrell, 2012; pg. 144). Each of these dimension of purchase risks usually have different significance on product or purchase risk or context; therefore, they must be considered independently by the consumer in determining their purchase decisions (Shaw, 2003; pg. 62). Therefore, these aspects or purchase risks will be considered independently in analyzing the factors influencing the purchase decisions of consumers to purchase technological cars. Literature Review The choice of customer is usually governed by the microeconomic theory that connects the preferences to consume goods and services in relation to the consumption expenditure. Therefore, choice of the customer usually affects the consumer demand curves. The relationship or the link between consumption, personal preferences, and demand curves is usually considered business economics since it helps in analyzing how the customer often achieves the equilibrium between expenditure and preferences (Crane and Mayer, 2003; pg. 179). This analysis is usually done by considering how the consumer maximizes utility as subject of budget constraints. Preference often presents the desire of an individual to consume a good and service thereby translating to consumer choices. Notably, these choices are usually based on wealth or personal income combined with the available time the consumer has to define consumption activities. The biggest difference is that the post-modern era has been marked with a great deal more impersonality then the pre-modern era. Whereas, in the pre-modern era, an individual could derive a sense of self and identity from their close connections – their neighbors, their churches, their family – in the post-modern era, this changed. Moreover, the role of the man has changed with the advent of the changes that have occurred in the post-modern era. Where he was the sole breadwinner in the pre-modern era, and this is where he derived his identity, in the post-modern era, the man has become less of a breadwinner and thus, according to some views, he became more of a consumer.Therefore, the male identity has changed substantially in this era. The following explains the broad nature of identity, then explains how individuals, in general, have been affected by the post- modern changes, then, finally, how men in particular have been affected by these changes. The nature of identity Identity is a dynamic social product, residing in psychological processes, which cannot be understood except in relation to its social context and historical perspective. (Breakwell, 1986, p. 9). It is a process that is developed over a person's entire life span.. Identity grows across time, but there is a nature of time that must be considered. Inner time is a duration, and is in tune with each person's cognitive rhythms. Martin (1987) references this time thusly - inner time is the realm of subjective consciousness of the individual. As we know from experience, the two may seem inconsistent, as when we talk of time flying or passing slowly. (Martin, 1987, p.199) This concept of time refers to our inner states. Intersubjective time is measured by face-to-face social interactions, by sharing experiences with others, thus moving through time conjointly. By sharing experien ces with others, the interactants come close to achieving a consensual appreciate of their conjoint movement through time. (Breakwell, 1986, p. 21). Biographical time refers to large chunks of time that are meaningful in one's life eras, such as adolescence, childhood, college years, married life, etc. There are also social and personal aspects to an identity. All humans have a division between self-identity and the performance of oneself that he puts out into the world, in specific social contexts (Giddens, 1991, p. 58). The personal identity, or real self, differs from one individual to another - some individuals' real self comes out when they act impulsively, other's real self is manifested when acting out social obligations. (Breakwell, 1986, p. 16). The real self may be looked at as being a person’s root core of who they are, and who they would be if there were not the influences of various social dynamics and constraints. (Tracy & Trethewey, 2005, p. 173). Another way o f looking at this concept is the private self, the self that known only to the individual, and the public self, the self that is known to others. These two aspects of identity both act in concert with one another and conflict with each other. Most individuals unconsciously deem one aspect more important than the other, and the favored aspect is the one that controls their behavior. (Brewer & Hewstone, 2004, p. 185). There is some theory that one's personal identity is only exposed when making moral decisions, as this exposes values, which are the cornerstone of presuppositions about the self. (Breakwell, 1986, p. 17). According to Anthony Giddens (1991), identity is a reflexive project. The premise of reflexive awareness is that an individual knows what they are doing, and why they are doing it. Humans monitor their circumstances, and are able to discursively explain why they are engaging in a certain behaviour.
